These Terms govern your use of the platform and all of its features, including but not limited to profiles, groups, forums, the marketplace, live streaming, messaging, posting content, and interacting with other users. This agreement applies to all users of the platform, including content creators, viewers, sellers, buyers, developers, and advertisers.

By using the platform, you agree to adhere to the rules we’ve set forth to maintain a respectful, safe, and law-abiding community. Failure to comply with these Terms may result in suspension or termination of your account, among other consequences, which we will detail in subsequent sections.

Acceptance of the Terms

By creating an account or using any aspect of our platform, you affirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms or any future modifications, you must discontinue your use of the platform immediately.   2. One Account per User: Users are generally permitted to have only one account per individual or entity unless explicitly authorized by Melaaj. Any attempt to create multiple accounts without permission may lead to account suspension.

  3. Age Verification: In compliance with local laws and our content moderation policies, certain content may only be available to users above a specified age (e.g., 18+). To access these restricted features, you may be required to verify your age by providing government-issued identification or completing another form of age verification.

Account Information Accuracy

It is your responsibility to ensure that your account information remains up-to-date and accurate. This includes your email address, phone number, and any other contact details that may be required for security purposes.

  1. Updating Information: You agree to promptly update your account information should any changes occur, such as a change in email or contact information. Failure to maintain accurate and updated information may prevent you from receiving important notifications or accessing your account.

  2. Consequences of Inaccurate Information: Providing false or misleading information may result in the suspension or termination of your account, as well as potential legal consequences if fraudulent activity is detected.

Account Security Responsibilities

The security of your account is paramount. By registering on the platform, you agree to maintain the confidentiality of your login credentials, including your username and password. You are fully responsible for any actions that occur under your account, whether or not authorized by you.

  1. Password Management: You are responsible for choosing a strong, unique password and keeping it secure. We recommend using a combination of uppercase and lowercase letters, numbers, and special characters. You should change your password regularly to minimize the risk of unauthorized access.

  2. Two-Factor Authentication (2FA): For enhanced security, we strongly encourage enabling Two-Factor Authentication (2FA) on your account. This adds an additional layer of protection by requiring a second form of verification (such as a one-time code sent to your phone) when logging in. Activating 2FA reduces the risk of unauthorized access and improves account security.

  3. Unauthorized Access: If you believe that your account has been compromised or suspect any unauthorized use of your account, you must notify us immediately. We will take appropriate measures to secure your account and may request additional verification to restore access.

  4. Account Recovery: In the event that you are locked out of your account due to forgotten credentials or suspected unauthorized activity, we provide recovery options such as email-based password resets or identity verification. It is crucial that you maintain access to the email address or phone number associated with your account, as this will be required for account recovery.

Unauthorized Account Use

You are responsible for all activities conducted through your account, and you agree not to allow any unauthorized person or entity to use your account. You will be notified of any such actions via email or in-platform notifications.

Account Suspension and Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or otherwise pose a security risk to the platform or its users.

  1. Grounds for Suspension or Termination:

    • Violation of Terms: Engaging in prohibited activities, violating community guidelines, or failing to comply with these Terms may result in account suspension or permanent termination.
    • Security Risks: Accounts that pose a security risk, whether due to unauthorized access, misuse of personal information, or suspected fraud, may be suspended immediately to protect both the user and the platform.
    • Inactivity: Prolonged periods of account inactivity (e.g., no login or activity for more than [X] months) may result in temporary suspension or termination of the account. Affected users will be notified and given the opportunity to reactivate their accounts.

These guidelines outline the behavior and activities expected of users and describe prohibited conduct that could lead to account suspension or termination. The guidelines apply to all activities on the platform, including posting content, interacting with other users, using the marketplace, and engaging in any other platform features.

Respectful Communication and Conduct

We are committed to fostering a community built on respect, inclusion, and meaningful interactions. To uphold these values, all users must engage in respectful communication, regardless of whether they are posting publicly or privately.

  1. No Harassment, Bullying, or Hate Speech: Any form of harassment, bullying, or intimidation is strictly prohibited. This includes sending threatening messages, engaging in harmful discourse, or targeting other users based on race, ethnicity, religion, gender, sexual orientation, disability, or any other personal characteristic. Hate speech or any content that incites violence, hatred, or discrimination will not be tolerated.

  2. Respecting Privacy: Users must respect the privacy of others. You may not post private or confidential information about another user without their explicit consent. This includes but is not limited to phone numbers, email addresses, home addresses, and any other sensitive personal information.

  3. No Impersonation: Users may not impersonate any individual, organization, or entity. Misleading or fraudulent accounts created to deceive or defraud others will result in immediate suspension or termination of the account.

  4. Avoiding Spam and Solicitation: Unsolicited or mass communication, advertising, or spam content is not permitted. Users should not engage in the repeated posting of unsolicited offers, promotions, or advertisements, especially those that are irrelevant or disruptive to the community. While we support legitimate commercial activities in our marketplace, all transactions should follow proper channels and not intrude on users’ experience outside of designated spaces.

Prohibited Content

Content shared on the platform must adhere to our standards of safety, decency, and legality. Users are responsible for the content they post and must ensure that it complies with all applicable laws and these guidelines.

  1. Illegal or Harmful Content: Users are not permitted to post or share any content that violates local, national, or international laws. This includes content related to illegal activities, criminal behavior, drugs, weapons, human trafficking, or any other unlawful conduct.

  2. Sexual or Explicit Content: We prohibit the posting of pornographic, sexually explicit, or excessively violent content. Melaaj is a platform for all users aged 13 and above, and we are committed to ensuring that content is appropriate for our audience.

  3. Violence and Threats: Content promoting violence, harm, or abuse against others, including threats or incitements to violence, is not allowed. This includes content that glorifies, encourages, or makes light of dangerous behaviors, such as self-harm or terrorism.

  4. Misinformation and Fake News: Users may not post deliberately false information, misleading content, or fake news intended to deceive others or create panic. We strive to ensure the platform is a reliable space for sharing and receiving accurate information. Content related to health misinformation, election fraud, or any other sensitive issue that can cause real-world harm will be removed.

  5. Copyright and Intellectual Property Violations: You must own or have the legal right to post the content you share. Posting content that infringes on the copyrights, trademarks, or intellectual property rights of others is strictly prohibited. If you are found to be sharing copyrighted material without proper authorization, the content will be removed, and your account may be suspended.

  6. Sensitive and Restricted Content: Certain sensitive content, such as graphic depictions of accidents, blood, or social issues, is restricted and will only be available to users who have verified that they are above the required age threshold (e.g., 18+). These posts may also be subject to automatic blurring or other content moderation tools in accordance with our “Guardian” content moderation feature. Any attempts to bypass these restrictions or share inappropriate content with underage users will result in account penalties.

Marketplace Usage Guidelines

The Melaaj marketplace allows users to buy and sell both physical and digital goods. To ensure a smooth and secure experience for both buyers and sellers, specific rules govern the usage of the marketplace.

  1. Honesty in Transactions: Sellers must provide accurate and truthful descriptions of the products they list in the marketplace. All items for sale must be genuine, and sellers may not offer counterfeit goods, illegal products, or items that violate the intellectual property of others.

  2. Prohibited Products: Certain items are not permitted for sale in the marketplace. These include, but are not limited to, drugs, weapons, stolen goods, pirated digital content, and hazardous materials. Any listing of prohibited items will be removed, and the responsible user may face suspension.

  3. Transaction Integrity: Both buyers and sellers must conduct transactions in good faith. Sellers are required to fulfill orders as described, and buyers are expected to make payments promptly. Any fraudulent activity, including fake listings, false payments, or refusal to ship goods, will result in the suspension of the offending account.

  4. Dispute Resolution: In case of a dispute between buyers and sellers, we offer a resolution process. Both parties are expected to cooperate during this process and provide accurate information regarding the transaction. Failure to resolve disputes may result in penalties, including refunds, account suspension, or removal from the marketplace.

User Earnings and Tip Systems

Our platform offers users opportunities to earn through various features, such as selling content, receiving tips, and creating subscription-based packages. The following rules apply to earnings and tipping systems:

  1. Earnings from Content: Users who offer paid content (e.g., posts, videos, or subscription-based services) must ensure that the content meets the platform’s standards and follows all applicable rules. Any fraudulent or misleading attempts to generate earnings will result in penalties.

  2. Tips and Donations: Users are allowed to receive tips or donations from other users. However, tips must be voluntary and cannot be solicited through harassment or coercion. Fraudulent activities, such as artificially inflating tips or using bots to generate income, are strictly prohibited.

Prohibited Use of Automated Tools

Users are not allowed to employ bots, scrapers, or any other automated tools to interact with the platform, harvest data, or perform activities that provide an unfair advantage or disrupt the normal user experience.

  1. Bots and Automated Accounts: The use of bots to automate posting, liking, or following activity is prohibited. All interactions on the platform must be organic and genuine.

  2. Scraping and Data Harvesting: Collecting data from the platform through automated means (e.g., scraping or crawling) is strictly prohibited. Such actions not only violate user privacy but may also result in legal consequences.

Consequences of Violating Usage Guidelines

Failure to follow these Platform Usage Guidelines may result in various consequences, depending on the severity of the violation. Penalties may include warnings, temporary suspension, permanent account termination, and legal action where applicable.

  1. Warnings: For minor infractions, users may receive warnings via email or in-platform notifications, advising them to correct their behavior.

  2. Suspensions: More serious violations, or repeated offenses, may result in temporary suspension of the account, during which time the user will be unable to access their profile or platform features.

  3. Permanent Termination: Severe or repeated violations, such as the posting of illegal content or malicious activities, may result in the permanent termination of the user’s account. Terminated accounts cannot be recovered or re-registered.

  4. Legal Action: In cases where platform violations also constitute breaches of the law, we reserve the right to take legal action against the offending user. This includes reporting the violation to relevant authorities and cooperating with investigations.

This section outlines the rights and responsibilities related to the content you post, as well as how Melaaj manages and utilizes user-generated content. By using our platform, you retain ownership of your content while granting us certain permissions necessary to operate and maintain the platform.

User Ownership of Content

As a user of Melaaj, you retain full ownership of any content that you create and post. This means that anything you upload—whether it’s a photo, a video, a blog post, or other types of media—remains your intellectual property. However, by posting on our platform, you also grant us specific rights to use, distribute, and display that content, which are essential for the platform’s operation.

  1. Your Rights as a Content Creator: You retain all rights to the content you create, including intellectual property rights such as copyright, trademark, and any other legal protections that may apply to your work. We do not claim ownership of your content, but by posting, you give us the necessary permissions to host, display, and distribute your content within the platform.

  2. Moral Rights: In addition to intellectual property rights, you retain moral rights to your content, which ensure that you are recognized as the creator of your work. You also maintain the right to object to any derogatory treatment of your content that could harm your reputation. Melaaj will always strive to respect these moral rights.

License to Melaaj

In order to operate the platform and provide services, you grant Melaaj a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, store, distribute, modify, and publicly display your content. This license is necessary for us to display your content to other users, optimize it for different devices, promote it (where applicable), and maintain backups.

  1. Scope of the License: The license you grant to us allows us to:

    • Host your content on our servers.
    • Display it to other users of the platform, either in public or private forums depending on your privacy settings.
    • Modify content for technical purposes, such as resizing images or compressing videos to improve load times.
    • Distribute content to other parts of the platform, such as in feeds, forums, or other areas.
    • Promote your content within the platform, including through sponsored posts, highlights, or featured sections, if you opt for these services.
  2. Term of the License: This license continues until you remove your content from the platform or delete your account, at which point we will cease using your content for any future distribution. However, archived copies of your content may remain in our backup systems for a limited period as required for security, compliance, or technical reasons.

  3. Sub-licensing: In some cases,Melaaj may need to share your content with third-party partners to enhance user experience, such as enabling integrations with other platforms or providing technical services. For example, if you link your account to a third-party service, we may need to provide them with access to your content as part of the service agreement.

User Responsibility for Content

You are solely responsible for the content you post on Mellaj. This means you must ensure that your content complies with our Platform Usage Guidelines and all applicable laws. Melaaj does not actively monitor user-generated content before it is posted, but we reserve the right to review, moderate, or remove content that violates these terms.

  1. Content Standards: All content must adhere to the standards outlined in the Platform Usage Guidelines. This includes prohibitions on illegal activities, hate speech, violence, harassment, and the sharing of explicit or misleading content. You are responsible for ensuring that the content you post does not infringe on the rights of others, including intellectual property rights or privacy rights.

  2. Consequences of Violating Content Standards: If your content violates these guidelines, it may be removed without prior notice, and your account could face penalties such as suspension or termination. We reserve the right to take down content that we, at our sole discretion, determine to be harmful, inappropriate, or otherwise in violation of these Terms and Conditions.

  3. Copyright Infringement: We take intellectual property rights seriously. If we receive a notice of copyright infringement regarding content you have posted, we will take appropriate action in accordance with applicable laws. This may include removing the content, terminating your account, or working with legal authorities if necessary. If you believe your content has been wrongfully removed due to a copyright claim, you may submit a counter-notice, and we will review the matter.

Prohibited Content

Certain types of content are strictly prohibited on Melaaj. You agree not to post or share content that:

  1. Violates the Law: This includes content that is illegal under local, national, or international law.

  2. Infringes Intellectual Property: You may not post content that infringes the copyright, trademark, or other intellectual property rights of others unless you have explicit permission from the owner.

  3. Contains Harmful, Offensive, or Dangerous Material: Any content that promotes violence, hatred, discrimination, self-harm, or other harmful behaviors is prohibited.

  4. Violates Privacy: You may not post content that discloses personal or confidential information about another individual without their consent.

  5. Is Explicit or Inappropriate for the Platform’s Audience: As a platform catering to users aged 13 and above, certain types of explicit content are not allowed. Sensitive content may be restricted using the “Guardian” content moderation system.

Content Removal and Moderation

While we do not pre-screen all content, Melaaj reserves the right to monitor, moderate, and remove any content that violates our guidelines or is deemed inappropriate for the platform.

  1. User Reporting: We encourage our community to report content that they believe violates these Terms. Reports will be reviewed by our moderation team, and if necessary, the content will be removed, and appropriate action will be taken against the account in question.

  2. Platform-Initiated Content Removal: In certain cases, we may proactively remove content that we detect as violating our guidelines, such as content flagged by our automated systems or our moderation team. When content is removed, the user will be notified of the reason and given the opportunity to appeal the decision.

  3. Appeals Process: If you believe that content you posted was removed in error, you have the right to appeal the removal. Appeals must be submitted through our designated support channels, where they will be reviewed by our moderation team. While we strive to resolve appeals promptly, the final decision on content removals rests with Melaaj.

Content Rights After Account Termination

If your account is terminated, either by you or by Melaaj for violating the platform’s rules, the content you have posted may no longer be accessible to other users. However, Melaaj reserves the right to retain and continue using content that has been previously shared with others (e.g., in group forums, public discussions, etc.).

  1. Publicly Shared Content: Content that has been shared publicly (e.g., forum posts, comments on public pages) may remain visible even after your account is deleted or terminated. We retain a limited license to display this content to ensure continuity of discussions and platform interactions.

  2. Archived Content: Copies of your content may remain in our backup systems for a limited time after your account is deleted, in accordance with our Data Retention policy. These backups are necessary for system recovery, legal compliance, and security.

User-Generated Content in Promotional Materials

We may showcase user-generated content in promotional materials, such as advertisements, newsletters, or social media posts, to highlight the creative and diverse activities on Melaaj. By posting content, you grant us the right to use your publicly shared content for such purposes, with appropriate attribution given when feasible.

  1. Attribution: When your content is featured in promotional materials, we will attribute the content to your username or profile, unless you have explicitly requested otherwise.

  2. Opting Out: If you prefer not to have your content featured in promotional activities, you may contact our support team to opt out of this feature.

At Melaaj, we offer a variety of services that may require payment, including purchases, subscriptions, and other premium features. This section provides detailed information on how financial transactions are processed, your rights and responsibilities as a user, and the options available for managing your payments.

5.1. General Terms for Purchases

Users can purchase products, services, and digital goods within Melaaj. These may include:

  • Physical Products: Items sold by other users or third-party vendors in the platform’s marketplace.
  • Digital Products: Downloadable content such as eBooks, artwork, software, or digital media.
  • Platform Services: Features like account upgrades, premium memberships, or content boosting.

When making a purchase, you agree to the following terms:

  1. Accurate Information: You must provide accurate and complete billing information for any purchases, including your full name, address, payment details, and any other information requested. Any inaccuracies or omissions may lead to delays or cancellations of your transactions.

  2. Payment Authorization: By initiating a purchase, you authorize us or our designated payment processors to charge the total purchase amount to your selected payment method. Payments may be processed via credit or debit card, e-wallet, bank transfer, or other supported payment methods available on the platform.

  3. Non-Transferable: Purchases are generally non-transferable. This means that digital items, subscriptions, or other services tied to your account cannot be transferred to another user without explicit permission from Melaaj.

  4. Pricing and Taxes: The price for products and services, including any applicable taxes or fees, will be clearly displayed at the time of purchase. Prices may change at any time without prior notice, but you will be charged the price that was displayed at the time of the transaction.

5.2. Subscription Services

  2. Automatic Renewal: Subscription plans may automatically renew at the end of each billing cycle, unless canceled in advance. If you do not cancel your subscription before the renewal date, you will be charged for the next billing period.

  4. Cancellation and Refunds: You may cancel your subscription at any time, but the cancellation will take effect at the end of the current billing cycle. No refunds will be issued for the remaining period of a subscription that has already been billed. However, in the event of a platform error, fraudulent activity, or unauthorized charges, you may request a refund or correction of the billing.

  1. Earnings and Payouts: If you earn money from your content, the funds will be deposited into your platform wallet. You may withdraw these funds to your bank account or digital wallet, subject to the minimum withdrawal thresholds and any applicable fees.

  2. Tip System: Users may tip creators for posts, live streams, or other types of content. These tips are entirely voluntary and may be subject to platform fees. Tips received will also be added to your platform wallet balance.

  3. Service Fees: Melaaj may charge service fees or commissions on earnings from user-generated content. The applicable fee structure will be disclosed in advance, and any deductions will be clearly itemized in your earnings summary.

5.4. Digital Goods and Non-Refundable Purchases

Certain purchases on Melaaj, such as digital content or virtual items, may be considered non-refundable. This includes items such as downloadable media, digital products, or premium services that are delivered instantly upon purchase.

  1. Non-Refundable Items: Once purchased, digital goods cannot be refunded or returned unless there is a proven technical issue or an error in the transaction. For example, if you purchase a downloadable eBook or artwork, you will not be eligible for a refund after the item has been downloaded.

  2. Refund Requests: In cases of accidental purchases, technical issues, or errors in billing, you may request a refund through our support team. Refund requests must be submitted within [X days] of the purchase date, and approval will be at the discretion of Melaaj.
